Terms of Service

Welcome to Oneshot Incarnate. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
1. Definitions
- Platform refers to Oneshot Incarnate, including the website, services, and all related functionality.
- User means any person who accesses or uses the Platform.
- Organizer means a User who creates and manages gaming sessions.
- Participant means a User who joins a gaming session.
- Venue Partner means a physical location partnering with us to host gaming sessions.
- Tokens are virtual currency used on the Platform to participate in sessions.
2. Acceptance of Terms
By creating an account or using the Platform, you acknowledge that you:
- Are at least 18 years old or have parental/guardian consent
- Have read, understood, and agree to these Terms
- Agree to comply with all applicable laws and regulations
- Understand that these Terms constitute a legally binding agreement
3. User Accounts
3.1 Account Creation
- You must provide accurate and complete information
- You are responsible for maintaining the confidentiality of your account
- You are responsible for all activities under your account
- One person may not maintain multiple accounts without our consent
3.2 Account Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Harassment or abuse of other Users
- Repeated no-shows to sessions without notice
- Any conduct we deem harmful to the Platform or community
4. Token System
4.1 Token Usage
- Tokens are required to organize and participate in sessions
- Tokens are held when you apply to a session and spent when the session is finalized
- Tokens are returned if an application is rejected or a session is canceled
- Game Masters earn 1.0 token back when they GM a finalized session
- Organizers who do not GM earn 0.5 tokens back when they finalize a session
- If you both organize and GM a session, you receive the GM credit (1.0 token), not both
- Home venue sessions cost 0.25 tokens per participant instead of 1.0 token
4.2 Token Purchases
When token purchases are available:
- Purchased tokens are non-refundable except as required by law
- Tokens have no cash value and cannot be redeemed for cash
- We reserve the right to adjust token pricing with notice
- Payment processing is handled by third-party providers
4.3 Promotional Tokens
- We may issue promotional or redeemable tokens at our discretion
- Promotional tokens may have expiration dates or usage restrictions
- We reserve the right to revoke promotional tokens for violations of these Terms
5. Gaming Sessions
5.1 Organizing Sessions
As an Organizer, you agree to:
- Provide accurate session information
- Finalize or cancel sessions in a timely manner
- Show up to sessions you've organized
- Manage applications fairly and in good faith
- Create a safe and welcoming environment for all participants
5.2 Participating in Sessions
As a Participant, you agree to:
- Check in when the check-in window opens (2 hours before)
- Arrive on time to sessions you've been accepted to
- Notify the Organizer if you must cancel
- Respect other participants and venue rules
- Provide honest feedback after sessions
5.3 Session Cancellation
- Organizers may cancel sessions but should provide as much notice as possible
- Sessions not finalized before their start time are automatically canceled
- All held tokens are returned when sessions are canceled
- Repeated cancellations may result in account restrictions
6. Code of Conduct
All Users must:
- Treat other Users, Venue Partners, and staff with respect
- Refrain from harassment, discrimination, or hate speech
- Not engage in illegal activities
- Not attempt to manipulate the token or reputation systems
- Not use the Platform for commercial solicitation without our consent
- Respect intellectual property rights
- Report violations of these Terms to us
Safety and Comfort: Sessions should use established safety tools (Lines & Veils, X-Card, etc.). Players should respect boundaries and create an inclusive environment.
7. Venue Partnerships
7.1 Venue Responsibilities
Venue Partners agree to:
- Provide the agreed-upon space during scheduled times
- Maintain a safe and accessible environment
- Handle facility-related issues promptly
- Comply with agreed financial terms
7.2 Financial Terms
- Revenue sharing or fixed fees are established per venue agreement
- Payments are settled according to agreed schedules
- Promotional tokens do not count toward venue revenue calculations
- Venue Partners are responsible for their own taxes and regulatory compliance
8. Intellectual Property
- The Platform and its content are protected by copyright and other laws
- You retain rights to content you create but grant us a license to use it
- You may not use our trademarks without permission
- Game system names and content belong to their respective owners
9. Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
- We are not responsible for interactions between Users
- We are not liable for injuries or property damage at venues
- We are not responsible for User-generated content
- Users participate in sessions at their own risk
- Our total liability is limited to the amount you paid us in the past 12 months
10. Indemnification
You agree to indemnify and hold harmless Oneshot Incarnate, Sawblades LLC, and their officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Platform or violation of these Terms.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Changes to Terms
- We may update these Terms at any time
- Material changes will be announced on the Platform
- Continued use after changes constitutes acceptance
- If you don't agree with new Terms, you should stop using the Platform
13. Dispute Resolution
13.1 Informal Resolution
Before filing a claim, please contact us at jason@oneshot-incarnate.com to resolve the issue informally.
13.2 Binding Arbitration
- Disputes will be resolved by binding arbitration rather than in court
- Arbitration will be conducted by the American Arbitration Association
- You waive the right to participate in class-action lawsuits
- Maryland law governs these Terms
13.3 Exceptions
Either party may seek injunctive relief in court for intellectual property disputes or violations of these Terms.
14. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and us.
- Severability: If any provision is found invalid, the rest remains in effect.
- No Waiver: Failure to enforce a provision doesn't waive our right to enforce it later.
- Assignment: You may not assign these Terms; we may assign them without restriction.
- Force Majeure: We're not liable for delays or failures due to circumstances beyond our control.
